Mr. Clary practices traditional labor law, employment law, OSHA/MIOSHA and litigation serving private and public employers and executives. His “can do” approach is grounded on practical solutions to advance the client’s strategic objectives, whether by phone-ready advice or complex planning. Employers--whether international corporation or corner store--have vastly more rights than restrictions if legal compliance is managed well.

Mr. Clary’s experience includes Fortune 100 to small proprietorships in many industries, county and municipal government, public health, and road and housing commissions. His labor relations expertise includes numerous cases before the National Labor Relations Board, Michigan Employment Relations Commission, and federal and state trial and appellate courts, many of which are published, involving, for example, unfair labor practices, union organizing and decertification, arbitration appeals and strikes. He has engaged in hundreds of collective bargaining negotiations, grievance and interest (police-fire) arbitrations and labor cases. Well versed in virtually all labor and contract issues, Mr. Clary counsels, develops policies and practices, and conducts training to build workplace rapport and reduce legal and operational risks, whether in a national in scope merger and acquisition or single employee medical leave, whether in cooperative or combative labor settings.

His 23 years of employment law advice to prevent lawsuits, and litigation expertise to win or settle advantageously when going to the mat is required, cover most areas, for example: forms, policies and handbooks; scores of federal and state investigations and charges (EEOC, US DOL, Wage and Hour Divisions, MDCR) and litigation, covering such matters as ADR, all civil rights from age to disabilities to race discrimination and harassment, executive contracts, FMLA, intellectual property and noncompetition to severance agreements, wages and hours, wrongful discharge, WARN to Whistleblower.

Mr. Clary’s OSHA and MIOSHA track record is successful preventative counseling, variances, dismissals, and favorable settlements reducing willful and repeat citations and large penalty reductions, including six-figure cases.
